New DS-1 Form Is Coming. This Time, For Real. (December 1, 2021)
According to a court order entered today, it appears that ATG/PNTN/ILTA have finally reached the end of their fight with IDFPR on the revised DS-1 form. The new DS-1 form will go into effect on March 1, 2022.
Worth noting, the Department still makes clear that the DS-1 form must be issued prior to the title commitment. This practically means that the burden on its correct completion may fall squarely onto the attorney-title agent, who should arguably be sending it to their Seller with their letter of engagement and both parties with their Attorney Review letter. It remains unclear how the form has to be completed, as the instructions don't specify what must be disclosed on the various lines.
